A Toronto mother and her common-law husband have been charged with second-degree murder in the death of her two-year-old son.
Police were called to hospital Sunday night in response to the death of the 26-month-old, Nicholas Cruz.
It is alleged the child had signs of physical trauma. A post-mortem examination is ongoing.
Marleny Cruz, 25, and Joel France, 36, have been charged. Additionally, France has been charged with assault. They appeared in court this morning and were remanded into custody. No family was in attendance at the hearing. Cruz asked the court to address her as Ms. France.
The victim and the accused lived in the Walnut St. and Richmond St. W. area of Toronto.
